Under the Thailand Civil and Commercial Code (CCC), child custody is legally integrated into a broader doctrine known as Parental Power (Amnat Pok-Krong). This guide provides an educational breakdown of how custody is determined, exercised, and protected under Thai family law, ensuring the best interests of the child remain paramount.

Understanding Parental Power and Custodial Rights

Parental power grants the legally recognized parent or appointed guardian the absolute right and duty to manage the upbringing, safety, and assets of a minor child until they reach the legal age of majority at 20 years old.

According to the CCC, individuals invested with parental power possess the following statutory rights:

The absolute right to designate where the minor child shall live or reside.
The right to discipline the child in a reasonable, non-abusive manner for corrective upbringing.
The authority to require the child to perform work or duties commensurate with their physical abilities and social status.
The statutory power to demand the return of the child from any third party who is unlawfully detaining them, including a biological parent who lacks legal custody rights.
The duty to manage the child's financial assets. Crucially, under Thai law, major financial transactions—such as selling, mortgaging, or leasing a minor’s real estate—strictly require prior administrative approval from the Family Court.

Custody Classifications: Married vs. Unmarried Parents
